General Use Policy

Illegal Activities

The customer may only use the Ex2 servers for legal purposes. The transmission of any material in violation of any national, federal or local regulations is prohibited. For this purpose, child pornography is strictly prohibited as well as hosting any copyrighted information (for which the customer does not hold the copyright or an appropriate license) on an Ex2 server. In addition, the use of Ex2 servers or networks to conspire, commit or support the commission of illegal activities is also prohibited.

Hacking

Websites dedicated to discussing hacking activities or distributing hacking tools are prohibited. In addition, the use of Ex2’s computer systems or network to access any system, service or network without the consent of the owner is expressly prohibited.

Service Interruptions

Any activity that causes service interruptions on Ex2 networks/servers or any external network. This includes, but is not limited to, the execution of denial of service attacks or other malicious software.

Anonymous Proxies

Anonymous proxies often have a negative impact on the servers and the network they are connected to. As such, they are prohibited on the Ex2 network and servers.

Spamming

Customer agrees not to present content on their site that advocates, sells or offers tools or methods for sending unsolicited emails or usenet messages (spam) or use the Ex2 hosting servers to relay unsolicited e-mails or usenet or to use unsolicited e-mails or usenet ads to advertise their site hosted by Ex2. Any complaint we receive about this kind of violation or the previous two items will be taken very seriously and will result in immediate cancellation of the account without refund.

Collection of personal information

Collecting or using email addresses, logins or other personal identifiers without the consent of the identified individual (including, but not limited to, phishing, Internet scam, password theft).

Black List

You agree that if Ex2’s IP addresses assigned to your account are listed in an abuse database or blacklist such as Spamhaus, you will be considered in violation of this GUP, and Ex2 may take reasonable steps to protect its IP addresses, including suspension and/or termination of your service, regardless of whether IP addresses have been listed as a result of your actions.

Spoofing / Impersonation

The use of the Ex2 network to impersonate another person or entity, whether by email, Internet forums or any other means, is strictly prohibited. This includes tampering with email or network packet headers, whether or not they are malicious purposes.

Personal Backups

With the exception of Ex2 Dedicated Servers products, the customer agrees to use Ex2 hosting servers primarily for the purpose of hosting a website and associated messaging functions. Downloaded data should be primarily for this purpose. Ex2 web hosting services are not intended to be used for data backup or archiving purposes. For example, you are not allowed to import or store personal mail archives. The transfer of all emails from another fully hosted email address for archival purposes is no longer permitted. In addition, email accounts cannot be used for file storage, such as security cameras, email storage used to transfer files, etc.

NOTE: We reserve the right to delete your email archives if they take a significant size on the server.

We also reserve the right to negotiate additional fees with the Customer and/or stop backups/archives at their discretion. If you exceed your assigned transfer bandwidth for one month, you will be charged at the rate of $1 per additional 10GB.

Shared Hosting Addendum

The following statements apply exclusively to shared Web hosting products and services offered by Ex2.

PROHIBITED CONTENT AND ACTIVITIES

Abusive scripts / processes

Any script/process/etc that negatively affects the ability of any other client to satisfactorily use its provided services is prohibited. This includes, but is not limited to, CGI/PHP scripts with high CPU demand and websites for which the number of visits exceeded the acceptable limits of a shared hosting environment.

IRC Bots / Bouncers

All IRC bots and bouncers (bnc, etc.) are prohibited.

BitTorrent Software

Although we recognize the value of the BitTorrent protocol as a distribution method, it is too easily (and often accidentally) abused/misused and is therefore not allowed on Ex2 shared hosting services.

Proxy Software

All proxy software, anonymous or not, is prohibited on Ex2’s shared hosting services.

Network daemons

Any process that opens a network socket to accept connections from external networks is prohibited. Processes are allowed to link to the local host only, but are subject to the limitations imposed on all other processes. They should not use more than their fair share of resources and should not interfere with the activities of other clients.

We reserve the right to delete data stored on our servers that violates any of the terms of our general terms of use.
